Conet Ltd. End User License Agreement (EULA)
By using or downloading Software of Conet Computer & Network Limited or its subsidiaries (“Conet”), you agree to the following terms and conditions. If you do not agree with such terms and conditions do not download the software or use the software. The terms of an end user license agreement accompanying a particular Software file upon installation or download of the Software shall supersede the terms presented below.
You are granted a non-exclusive license to the Software for non-commercial use only.
Scope
You may: install the Software on one or more computers or virtual machines; use the Software on a network, provided that each person accessing the Software through the network has a copy licensed to that person; copy the Software for archival purposes, provided that any copy contains all of the original Software’s proprietary notices.
You may not: redistribute the software in any form; permit other individuals to use the Software except under the terms listed in this agreement; modify, translate, reverse engineer, decompile, disassemble (except to the extent applicable laws specifically prohibit such restriction), or create derivative works based on the Software; sell, rent, lease, grant a security interest in, or otherwise transfer rights to the Software; remove any proprietary notices or labels on the Software.
Disclaimer of Warranty
The Software is provided on an “AS IS” basis, without warranty of any kind, either expressed or implied, including but not limited to, the warranties of merchantability, fitness for a particular purpose and non-infringement. The entire risk as to the quality and performance of the Software is borne by you. Should the Software prove defective, you assume the entire cost of any service, repair or correction. This disclaimer of warranty constitutes an essential part of the agreement.
Intellectual Property
Title, ownership rights, and intellectual property rights in the Software shall remain with the Author. The Software is protected by copyright laws and treaties. Title and related rights in the content accessed through the Software is the property of the applicable content owner and may be protected by applicable law. This License gives you no rights to such content.
Termination
The license will terminate automatically if you fail to comply with the limitations described herein. On termination, you must destroy all copies of the Software.
Limitation of Liability
THE AUTHOR DISCLAIMS ALL WARRANTIES WITH REGARD TO THIS SOFTWARE, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS. IN NO EVENT, UNLESS REQUIRED BY APPLICABLE LAW, SHALL THE AUTHOR BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES, ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE (INCLUDING BUT NOT LIMITED TO LOSS OF USE, DATA OR PROFITS), WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THIS SOFTWARE EVEN IF YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
High Risk Activities
The Software is not fault-tolerant and is not designed, manufactured or intended for use or resale as on-line control equipment in hazardous environments requiring fail-safe performance, such as in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, direct life support machines, or weapons systems, in which the failure of the Software could lead directly to death, personal injury, or severe physical or environmental damage (“High Risk Activities”). The Author specifically disclaims any express or implied warranty of fitness for High Risk Activities.
